Welcome to SunSpark Studios, LLC These Terms and Conditions (“Terms”) govern your use of our website, services, and related platforms (collectively, the “Site”). By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree, you must not use our Site.

 

1. Scope of Services

1.1 We specialize in motion picture production, including but not limited to:

  • Feature films, short films, documentaries, commercials, and branded content.

  • Pre-production, production, and post-production services.

  • Casting, crew hiring, set design, equipment rental, and related film industry services.

1.2 Any specific services, deliverables, and timelines will be detailed in individual production agreements or contracts.

 

2. Eligibility

2.1 By using this Site, you represent that you are at least 18 years old and legally capable of entering into binding contracts.
2.2 If you are accessing the Site on behalf of a company or organization, you represent that you have the authority to bind that entity.

 

3. Intellectual Property Rights

3.1 Website Content: All text, images, video reels, graphics, logos, designs, and other materials on this Site are owned or licensed by the Company and protected under copyright, trademark, and other intellectual property laws.

3.2 Produced Materials:

  • Unless otherwise specified in a signed contract, all motion picture productions, footage, scripts, designs, treatments, and related works created by us remain the sole intellectual property of the Company until full payment has been made.

  • After full payment, ownership and licensing rights will transfer as per the terms of the production contract.

3.3 You may not copy, distribute, modify, display, or use our intellectual property without prior written permission.

 

4. Confidentiality & Non-Disclosure

4.1 During the course of engagement, both parties may exchange confidential information, including scripts, budgets, production details, or creative concepts.
4.2 Both parties agree not to disclose or use such information for purposes outside of the intended collaboration.
4.3 These obligations survive termination of any agreement.

 

5. User Responsibilities

5.1 You agree not to misuse the Site, including but not limited to:

  • Uploading harmful, illegal, or infringing content.

  • Attempting to gain unauthorized access to our servers or networks.

  • Misrepresenting your identity, affiliation, or authority.

5.2 If you submit materials (e.g., scripts, treatments, resumes), you represent that you own or have the right to submit such materials and grant us a non-exclusive, royalty-free license to review them for potential collaboration.

 

6. Payment & Fees

6.1 Payment terms, fees, and schedules will be outlined in specific production agreements.
6.2 Late payments may incur interest or suspension of services until payment is received.
6.3 All payments are non-refundable unless otherwise agreed in writing.

 

7. Liability & Warranties

7.1 The Site and its content are provided “as is” without warranties of any kind.
7.2 While we strive for accuracy, we do not guarantee that the Site or its content will be error-free, uninterrupted, or fully secure.
7.3 The Company shall not be liable for:

  • Delays caused by force majeure events (e.g., strikes, weather, pandemics).

  • Losses arising from third-party vendors, talent, or collaborators.

  • Indirect, incidental, or consequential damages.

 

8. Third-Party Links & Services

8.1 The Site may contain links to third-party websites or services. We do not endorse or assume responsibility for their content, policies, or practices.
8.2 Any dealings with third-party vendors are at your own risk.

9. Termination

10.2 Any disputes shall be resolved in the courts of Orange County, and you consent to such jurisdiction.

 

11. Amendments

11.1 We may update these Terms from time to time by posting a revised version on this Site.
11.2 Continued use of the Site after updates constitutes acceptance of the revised Terms.
